Terms & Conditions

1. General provisions:
1.1. Terms and conditions, hereinafter referred to as "Terms", is a mandatory document that reglaments the Seller's and the Buyer's rights and obligations, acquisition and payment conditions, delivery and return order, parties' responsibilities and other terms regarding the buying-selling process in this internet shop.
1.2. A natural person is eligible to buy in this internet shop; minors aged 14-18 are eligible to buy items with parental consent only, with an exception of independant income cases; a legal person; representatives of mentioned parties.
1.3. By placing an order the buyer verifies that the Terms are known to him and agrees to commit to them.
1.4. The agreement between the Parties shall be considered confirmed as the Buyer places an order, reads the Terms, enters information required for this agreement and delivery or clicks on "Buy" button.
1.5. The Seller has a right to change, fix or add any rules to the Terms, as long as national laws are taken into consideration. The changed rules apply from the moment they're published on the site.
1.6. The Seller is not responsible and does not compensate the Buyer's loss that originated while derogating to the Terms.

2. Privacy policy:
2.1. The Buyer must enter their information when registering or ordering.
2.2. The Buyer is responsible for the information to be correct.
2.3. When ordering, the Buyer gives his consent for information regarding the order to be sent to his e-mail or phone.
2.4. The Buyer agrees to the usage of his personal information for analysis or direct marketing purposes.
2.5. The Buyer that does not want the consent to use his e-mail or phone number for purposes of direct marketing to be given shall inform the Seller about his decision.
2.6. The Seller cannot reveal the Buyer's personal information to third parties, exclusions apply according to LR law.
2.7. In order to provide the Buyer fully fledged usage of the internet shop, the Seller places Cookies in the Buyers computer. The placed information the Seller uses to identify the Buyer, to save the information of the items in the cart, to gather statistics of the site traffic. The Buyer is able to review, delete or disagree to the usage of Cookies - in this case, some functions of the site might be unavailable to the Buyer. The Buyer accepting to the Terms agrees to the usage of Cookies in the site. This consent can be cancelled at any time by changing his web browser preferences or by contacting the Seller.

3. The Buyer's rights:
3.1. The Buyer has a right to buy goods from the Seller obeying to the mentioned Terms.
3.2. The Buyer has a right to cancel this agreement by contacting the Seller in written form(via e-mail by including the order number and the item to be returned) within 14 days working days since the receivement of the items.
3.3. The Buyer can use the right mentioned in 3.2 only if the item hasn't been damaged, used or changed it's appearance.
3.4. The buyer can use the right mentioned in 3.2 only if it applies to the Agriculture Minister's "The rules of selling items and providement of service using network connections" ordinance Number 258 released in 2001 August 17th.

4. The Buyer's responsibilities:
4.1. The Buyer has to pay for the ordered goods and take them according to the Terms.
4.2. When using the internet shop, the Buyer agrees to obey to Republic of Lithuania's law.

5. The Seller's  rights:
5.1. The Seller has a right to change, fix or add any rules to the Terms at any time according to the law.
5.2.  If the Buyer is trying to harm the stability or safety of the internet shop or does not act according to the Terms, the Seller has a right to immediately, without a warning sustain or disable the Buyer's usage of the internet shop.
5.3. The Seller has a right to set a minimal size of the cart, that meaning the minimal amount of money. If not reached, the Seller has a right not to process the Buyer's order.T
5.4. The Seller has a right to cancel the Buyer's order if the payment is not made within 3 working days.

6. The Seller's responsibilities:
6.1. The Seller is responsible for the conditions and proper processing of the internet shop.
6.2. The Seller is responsible to protect and respect the Buyer's personal information according to the Republic of Lithuania's Law.
6.3. The Seller is responsible for the delivery of the items to the Buyer's address.
6.4. If the Seller is unable to deliver the Buyer's order, the Seller is responsible to offer a similar item to the Buyer. If the Buyer refuses the offer, the Seller shall refund the money within 7 working days.
6.5. If the Buyer returns the item as described in 3.2 and 3.3, the Seller has to process a refund within 7 working days.

7. The Buyer's payment options are these:
7.1. The prices in the internet shop are displayed in EUR, including VAT.
7.2. If the Buyer contacted the Seller regarding the payment and wants to pay via internet bank, the Buyer is obliged to pay within 3 working days and the item is dispatched only after the payment is made.
7.3. The Buyer's payment options are these:
  7.3.1. Internet bank via Paysera system. The payment is generated according to the order. The money is transferred by the Seller to KUKUI's bank account. The privacy policy in this case is according to the bank, in which the payment is processed.
  7.3.2. Using Paypal pre-payment system. The privacy policy is according to Paypal system administration.
  7.3.3. Paying by Visa or MasterCard credit card.
  7.3.4. By making a payment according to an invoice.

8. Shipping, delivery and acquisition:
8.1. The goods are delivered via "Omniva" parcer machine or via Courier(if prefered by the Buyer).
8.2. The price of delivery is an additional payment, it is not included in the price of the item. The delivery to the Buyer's address costs according to the Buyer's choice of Shipping.
8.3. The Seller submits the items to the Buyer according to the time in the item's description. The delivery times are preliminary, does not include the occurence when the Buyer does not have an item in stock and the Buyer is informed of the issue. The Buyer agrees, that in exceptional occurences the delivery of the items might be late due to unpredicted circumstances. In that case the Seller must contact the Buyer immediately and agree to the conditions of an order's delivery.
8.4.  In all possible cases the Seller is excused from the responsibility of an order's late arrival if it's due to unpredicted circumstances.

9. Quality and guarantee:
9.1. All the possible information about the product must be presented next to the item.
9.2. The Seller is not responsible for color, shape, size or other traits' differences from the product picture if it's due to the Buyer's monitor's capabilities or settings.
9.3. The Seller's quality guarantee does not restrict or prejudice the rights of the users if given a faulty item.
9.4. The Seller can guarantee the quality of some items for a period of time. The time period and the terms applied must be presented in an item's description.
9.5. If by any chance the Seller does not guarantee the quality of some items, the guarantee by the law applies.

10. Returns and refunds:
10.1.The returns are taking place according to LR Agriculture minister's 2001 June 29th ordinance Number 217 "The rules of return and exchange of a bought item", 2013 December 19th civil code changes and the addition to the law number XII-700.
10.2. If the Buyer wishes to return an unfaulty item, it can be done within 14 days from the delivery of the items. The Buyer must inform the Seller via e-mail and fill out a return form.
10.3. The returned item must be in it's original packaging, undamaged, unused, in the same condition as it arrived, with tags attached. The Parties agree, that any necessary changes made to the item in order to inspect an item is not considered to be a change of the condition. The return form must include a document, proving the payment for the item.
10.4. The Seller shall accept the items and change them to analogues if the wrong or faulty item was sent to the Buyer.
10.5. In case the Seller is unable to change the item, the Buyer is eligible to get a full refund, including the postage costs.
10.6. In case the Buyer is returning a discounted item, the refunded amount is the same as paid.
10.7. The Seller has to send the returned items via Registered Mail or Parcel Machine.
10.8. The postage cost for return or exchange of items that are not faulty is paid by the Buyer.

11. The Seller's marketing uses:
11.1. The Seller has a right to initiate discounts or sales on his own will.
11.2. The Seller has a right to change the conditions or cancel the sale without a warning. Any change of such nature comes into effect from the moment it's made.
11.3. The Seller can send information to the Buyer's contacts entered in the registration form.
11.4. The Buyer can send inquiries and ask questions by sending them to the Seller's telephone or email, mentioned in the Seller's "Contact us" page.
11.5. The Seller is not responsible if the Buyer is not in possesion of any information or confirmation letters due to the Buyer's internet connection, e-mail service errors or wrong information presented by the Buyer.

12.  Responsibilities:
12.1. The Buyer is in absolute responsibility to present correct personal information. If wrong information is given, the Seller is not responsible for the outcome of this issue and obtains a right to require a compensation for losses due to the matter.
12.2. The Buyer is responsible for his actions while using this internet shop.
12.3. The registered Buyer is responsible for his sign-in information protection. If "go.Kukui.com" is used by a third party, signed in to the account of the Buyer, the Seller considers the third party as the Buyer.
12.4. The Seller is excused from any responsibility if losses are experienced due to the Buyer's ignorance of the Seller's recommendations and the Buyer's responsibilities or the Terms, even though the access to the Terms was offered.
12.5. The Seller is not responsible for the Buyer's and the Seller's partners, whose services are ordered by the Buyer, proper mutual commitments.
12.6. If a loss occurs, the guilty Party must compensate it to the other.

13. Final provisions:
13.1. The Terms and Conditions were made according to the Law and Legal Orderence of Republic of Lithuania.
13.2. The relations arising in the Terms are regulated by Republic of Lithuania's Law.
13.3. All disputes regarding the enforcement of the Terms, are solved by negotiating. If an agreement is failed to be reached, the disputes are solved by the law of Republic of Lithuania.
